Livestock Purchase Terms

These Livestock Purchase Terms ("Livestock Terms") apply to all livestock listings, deposits, purchases, auctions, embryo purchases, Build A Bougie Baby orders, and related transactions with Bougie Cattle Company ("Bougie Cattle Company," "we," "us," or "our"). They should be read together with our Terms of Service and any invoice, listing, auction terms, bill of sale, or written agreement applicable to your purchase. Where these Livestock Terms conflict with a signed written agreement, the signed agreement controls.

1. Deposits and Payment Options

For available livestock listed on our website, you may either:

  1. Pay a $250 non-refundable deposit to reserve the animal or begin the purchase process; or

  2. Pay the full purchase price at the time of purchase by credit card, where available.

A livestock deposit reserves the selected animal or purchase opportunity and is non-refundable for any reason. Once a deposit or payment is made, the animal may be removed from availability, and we may decline other interested buyers. For that reason, deposits and livestock payments are final unless otherwise stated in a written agreement signed or confirmed by Bougie Cattle Company. A deposit reserves the animal but does not transfer ownership until the full purchase price and any applicable fees have been paid.

2. Payment Methods and Balances

If you pay only the $250 deposit at checkout, we may invoice you within 48 hours for the remaining balance. Remaining balances may be paid by wire transfer, cash, ACH, or credit card, subject to approval and any applicable fees. Payment instructions, due dates, pickup timing, and any remaining requirements will be communicated after your deposit is received.

By submitting payment, you authorize us and our payment processors to charge the agreed amount. If the balance is not paid by the due date, we may cancel the sale, retain the deposit, and offer the animal to another buyer.

3. Credit Card Fees and Insurance

All livestock purchases paid by credit card will include:

  • An 8% insurance charge

  • A 2% credit card surcharge

These charges will be itemized in your cart or invoice where applicable. For livestock orders paid by cash, ACH, or wire transfer, there is no credit card surcharge, and insurance is optional unless otherwise stated in writing.

Calf insurance covers your calf purchase for one year from your pickup date, subject to the applicable insurance terms, limitations, exclusions, and claim requirements. Insurance coverage is provided according to the insurance program terms and is not a guarantee by Bougie Cattle Company unless expressly stated in writing.

4. Availability and Condition

Livestock are living animals. Availability, health, condition, temperament, appearance, size, weight, color, registration status, genetics, pregnancy status, delivery timing, and other characteristics may change before pickup or delivery. We make reasonable efforts to provide accurate information, but no guarantee is made unless expressly provided in a written agreement signed or confirmed by Bougie Cattle Company.

5. Health and No Warranty

Unless expressly stated in a signed written agreement, livestock are sold "as is." We do not provide any warranty, express or implied, regarding health, soundness, fertility, breeding ability, production, temperament, suitability, or fitness for a particular purpose. Any health records, vaccinations, testing, or veterinary information we provide are shared for convenience and are not a guarantee.

Buyers are encouraged to inspect the animal and obtain an independent veterinary examination before purchase or pickup.

6. Remaining Balances, Transport, Pickup, and Risk of Loss

Any remaining balance must be paid in full before pickup, transport, delivery, or transfer of the livestock unless otherwise agreed to in writing. We reserve the right to hold, delay, or cancel pickup, transport, delivery, or transfer until all required payments, paperwork, and purchase terms are completed. Failure to pay the remaining balance by the required deadline may result in forfeiture of your deposit and cancellation of the purchase.

Unless otherwise agreed in writing, the buyer is responsible for arranging and paying for transport. Risk of loss passes to the buyer upon pickup or upon the animal being loaded for transport, whichever occurs first. The buyer is responsible for ensuring transport is safe, legal, and appropriate for the animal.

If an animal is not picked up by the agreed date, additional boarding, feed, or care fees may apply, and we are not responsible for changes in the animal's condition after that date.

7. Registration and Documentation

Where applicable, registration papers, transfers, or documentation will be provided according to the applicable breed association rules and the written agreement. Registration transfer fees and timing are the buyer's responsibility unless otherwise stated.

8. Embryo Purchases

For embryo purchases, we require a $250 non-refundable deposit, or you may pay the full amount at the time of purchase where available.

The same payment terms, credit card surcharge, insurance-related terms where applicable, and non-refundable deposit rules described above apply to embryo purchases unless otherwise stated in a written agreement.

Embryo purchases may be subject to additional terms related to availability, transfer, storage, shipping, veterinary procedures, recipient animals, pregnancy outcomes, and other biological or logistical factors. No guarantee is made unless expressly provided in writing by Bougie Cattle Company.

9. Build A Bougie Baby Orders

For Build A Bougie Baby orders, you may pay the full price upfront under the terms and fees described above, or you may follow the staged payment process below.

Step 1 — $250 Today. Pay $250 today to place your order and lock in your selected pairing. This payment is a non-refundable deposit.

Step 2 — $6,000 Deposit. Bougie Cattle Company will contact you to finalize your $6,000 deposit. This deposit may be payable by ACH or credit card; credit card payments may incur a processing fee or surcharge. The $6,000 deposit is non-refundable once paid.

Step 3 — $6,000 Before Pickup. Once the deposit is paid, the remaining $6,000 balance is due before pickup. No animal may be picked up, transported, delivered, or transferred until the full balance and any applicable fees are paid in full and all required paperwork is completed.

Build A Bougie Baby orders involve live animals, breeding selections, pairing availability, timing, biological outcomes, scheduling, care, and other factors outside of Bougie Cattle Company's full control. No specific outcome, timing, color, sex, size, temperament, conformation, registration, pregnancy, embryo result, or future value is guaranteed unless expressly stated in a written agreement signed or confirmed by Bougie Cattle Company.

10. Buyer Responsibilities

The buyer is solely responsible for understanding and meeting all responsibilities of livestock ownership, including transport, housing, fencing, feeding, water, veterinary care, registration, insurance, brand inspection, health certificates, permits, and compliance with all local, state, and federal laws.

11. Auctions and Third-Party Platforms

Livestock sold through auctions or third-party platforms may be subject to that platform's separate terms, fees, bidding rules, and dispute processes. We are not responsible for third-party platform outages, bidding errors, or technical problems, except where required by law.

12. Chargebacks and Payment Disputes

Bougie Cattle Company does not permit improper or unauthorized credit card chargebacks for valid livestock, embryo, or Build A Bougie Baby purchases, deposits, or payments.

By making a purchase or paying a deposit, you agree to contact Bougie Cattle Company first at jo@bougiecattleco.com before initiating a payment dispute or chargeback so we can review and attempt to resolve the matter.

Filing an improper chargeback for a valid, non-refundable purchase may result in cancellation of services, forfeiture of deposits, denial of future bookings or purchases, collection activity, recovery of chargeback fees, and any other remedies available to Bougie Cattle Company under applicable law.

Nothing in this policy limits any rights you may have under applicable law for unauthorized transactions, fraud, or billing errors.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim related to a livestock, embryo, or Build A Bougie Baby transaction shall not exceed the amount you paid to Bougie Cattle Company for the specific animal or order giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

14. Governing Law

These Livestock Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be brought in the state or federal courts located in California, unless otherwise required by law or agreed in writing.
